1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Keyvalue Software Systems Private Limited (“Company”, “we”, “us”, or “our”) governing your access to and use of Pickle, including the mobile application, website, mobile web app, and all related services available at Pickleit.ai (collectively, the “Service”).

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you may only use the Service with the consent of a parent or legal guardian, in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable law.

By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

4. Account Registration and Security

To access core features of Pickle, you must create an account using your mobile phone number and OTP-based verification. You agree to:

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

5. Service Description

Pickle is an AI-powered content creation platform that enables users to generate personalised images and videos. The Service works as follows:

Note: AI-generated outputs may vary in quality and accuracy. Generation times typically range from 5–30 seconds for images and 1–8 minutes for videos, depending on complexity and server load. We do not guarantee specific output quality, likeness accuracy, or generation times.

6. User Content and Uploads

By uploading photos or other content to the Service, you represent and warrant that:

You grant Pickle a non-exclusive, worldwide, royalty-free, limited licence to use, process, store, and transmit your User Content solely for the purpose of providing, operating, securing, and supporting the Service (excluding use of your User Content to train or fine-tune machine learning models, as described in our Privacy Policy). This licence terminates when you delete your content or account, except to the extent we are required to retain data for legal or regulatory purposes.

Your content is never used to train AI models. User-uploaded photos and generated outputs are processed solely to deliver the Service. Third-party AI providers are contractually prohibited from using your content for their own model training.

Personal photos may be transmitted to OpenAI (GPT Image 2), Google (Gemini), and to KLING and/or Higgsfield for inference only to fulfil your generation request. Photos that may depict faces, and what is sent to which vendor, are explained in the Privacy Policy (Face-Related Information in User Photos).

Subject to your compliance with these Terms and your available Credits or entitlements:

Pickle does not claim ownership of Generated Content. However, we retain the right to use anonymised, aggregated generation metadata (such as template popularity and generation success rates) to improve the Service.

9. Content Moderation and Enforcement

Pickle may employ automated content moderation on still images (including AWS Rekognition when that feature is enabled in our environment) to scan uploaded content for policy violations. Moderation can be turned off in a given deployment; when it is on, video uploads may not go through the same image-based path. We reserve the right to:

Strike System: Violations of our Acceptable Use Policy may result in strikes on your account. Accumulation of strikes will lead to temporary suspension and, ultimately, permanent account termination. The severity and number of strikes depend on the nature and frequency of violations.

Content moderation decisions are made at our sole discretion. While we strive to be fair and consistent, we do not guarantee review of every piece of content and are not liable for any content that may bypass our moderation systems.

10. Credits and Payments

Pickle operates on a credit-based usage model. You may purchase individual credit bundles to generate images and videos. A free tier (“Explorer”) with limited usage may also be available, as described in Section 11.

How Credits Work

Credit Bundles and Pricing

Credit bundles are sold as one-time purchases. The number of Credits included in each bundle and the price are displayed on the purchase screen at the time you buy.

Transition from Subscriptions to Credits

Important change for existing subscribers: Pickle is discontinuing auto-renewable subscription plans. All active Legacy Subscriptions will be cancelled. Going forward, access to premium generation features is provided through the Credits system and the purchase of individual credit bundles.

If you had an active Legacy Subscription or held image or video credits in your account balance under the previous system, the following applies:

Billing and Charges

Cancelling Legacy Subscriptions

If you still have an active Legacy Subscription on your Apple or Google account, you should cancel it through the platform where you originally subscribed to avoid any further charges after our transition:

Important: Simply deleting the Pickle app from your device does not cancel a Legacy Subscription on your Apple or Google account. You must cancel through the appropriate platform settings if a subscription remains active there.

Credit balances, bundle availability, generation costs, and related entitlements may be modified by us with reasonable notice where required. We reserve the right to adjust Credit consumption rates, bundle offerings, and promotional terms to reflect changes in the Service or underlying costs.

11. Free Tier and Watermarks

Pickle offers a free tier (“Explorer”) with limited features and usage. Content generated on the free tier may include a visible watermark. You agree not to:

Purchasing Credits or credit bundles removes watermarks from newly generated content and may unlock additional features, higher resolution outputs, and increased usage limits.

12. Refunds and Cancellations

Credit bundle purchases made through the Apple App Store and Google Play Store are managed by the respective platform. Pickle does not directly process refunds for in-app purchases made through these stores.

Legacy Subscription Cancellations

If you still have an active Legacy Subscription, you must cancel it through the platform where the purchase was made to stop future charges:

Please note: Cancellation of a Legacy Subscription takes effect at the end of the current billing period on the applicable platform. You may retain subscription entitlements until that period ends. No partial refunds are issued for the remaining portion of a cancelled billing period, unless required by applicable law or the respective platform’s policies. Remaining image and video credits will be converted to the unified Credits system as described in Section 10.

Simply deleting the Pickle app from your device does not cancel a Legacy Subscription. You must cancel through the appropriate platform settings to stop future charges.

13. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the following, are owned by or licensed to Keyvalue Software Systems Private Limited:

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, reverse-engineer, or otherwise exploit any part of the Service or its intellectual property without our prior written consent.

14. Third-Party Services

The Service relies on third-party providers for AI generation, cloud infrastructure, payments, analytics, and other functions. These include, but are not limited to:

Personal photos and template selections you submit for AI features may be sent only to the inference providers listed above for the purpose of generating your requested output, consistent with our Privacy Policy.

We are not responsible for the availability, accuracy, or performance of third-party services. Outages, changes, or discontinuation of third-party services may affect the availability or functionality of the Service. Your use of third-party services is subject to their respective terms and policies.

15. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties including, but not limited to:

To the maximum extent permitted by applicable law, Keyvalue Software Systems Private Limited, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of business, or reputational harm, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 5,000 (Indian Rupees Five Thousand), whichever is greater.

You agree to indemnify, defend, and hold harmless Keyvalue Software Systems Private Limited, its directors, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved as follows:

We reserve the right to modify, update, or replace these Terms at any time. If we make material changes, we will notify you through the website, mobile application, push notification, or other reasonable means prior to the changes taking effect.

The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
