1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Keyvalue Software Systems Private Limited (“Company”, “we”, “us”, or “our”) governing your access to and use of Pickle, including the mobile application, website, mobile web app, and all related services available at Pickleit.ai (collectively, the “Service”).

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Definitions

• “Content” means any photos, images, videos, text, templates, or other materials uploaded, created, generated, or shared through the Service.
• “User Content” means any photos, images, or other materials that you upload to the Service for the purpose of generating AI outputs.
• “Generated Content” means AI-generated images or videos produced by the Service using your User Content and selected templates.
• “Template” means a pre-designed style, layout, or creative configuration provided by Pickle that users can select to generate personalised content.
• “Subscription” means a paid plan that grants access to premium features, higher usage limits, and additional capabilities within the Service.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 17 years of age, you may only use the Service with the consent of a parent or legal guardian, in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable law.

By using the Service, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

4. Account Registration and Security

To access core features of Pickle, you must create an account using your mobile phone number and OTP-based verification. You agree to:

• provide accurate and current information during registration;
• maintain the security of your account credentials and device access;
• notify us immediately of any unauthorised use of your account;
• not create more than one account per individual;
• not share, transfer, or sell your account to any other person.

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

5. Service Description

Pickle is an AI-powered content creation platform that enables users to generate personalised images and videos. The Service works as follows:

• Template Selection: Browse and select from a library of curated templates and creative styles.
• Photo Upload: Upload one or more photos from your device camera or photo library.
• AI Generation: Your photos and selected template are processed using third-party inference services: Google Gemini (for AI image generation and, where applicable, image or frame preparation in the video workflow) and KLING and/or Higgsfield (for AI video generation, depending on the template and how our service is configured), as described in our Privacy Policy (including Section 7).
• Output Delivery: View, download, save to your studio, and share your generated content.

6. User Content and Uploads

By uploading photos or other content to the Service, you represent and warrant that:

• you own the content or have obtained all necessary rights, permissions, and consents to upload and use it;
• if the content contains another person’s likeness, you have that person’s explicit consent for their image to be processed by AI services;
• the content does not infringe any third party’s intellectual property, privacy, publicity, or other legal rights;
• the content does not violate any applicable law, regulation, or these Terms.

You grant Pickle a non-exclusive, worldwide, royalty-free, limited licence to use, process, store, and transmit your User Content solely for the purpose of providing, operating, securing, and supporting the Service (excluding use of your User Content to train or fine-tune machine learning models, as described in our Privacy Policy). This licence terminates when you delete your content or account, except to the extent we are required to retain data for legal or regulatory purposes.

7. AI-Generated Content

Subject to your compliance with these Terms and any applicable subscription terms:

• you may use Generated Content for personal, non-commercial purposes without restriction;
• commercial use of Generated Content (including advertising, merchandise, or resale) may be restricted or require a separate written agreement with us; paying for a subscription removes watermarks and adjusts usage limits but does not, by itself, grant an unlimited commercial licence unless we state otherwise in writing for your plan;
• you acknowledge that AI-generated outputs may not perfectly replicate likenesses, may contain visual artifacts, and are provided on an “as-is” basis;
• you may not claim that AI-generated content was created by a human or misrepresent its origin;
• you are solely responsible for how you use, distribute, or share Generated Content.

Pickle does not claim ownership of Generated Content. However, we retain the right to use anonymised, aggregated generation metadata (such as template popularity and generation success rates) to improve the Service.

8. Acceptable Use Policy

You agree not to use the Service to:

• generate, upload, or distribute content that is illegal, obscene, pornographic, defamatory, threatening, harassing, or hateful;
• create deepfakes, misleading media, or content intended to deceive, defraud, impersonate, or harm any person;
• generate content depicting minors in any inappropriate, suggestive, or harmful context;
• upload photos of individuals without their knowledge or consent for the purpose of creating non-consensual imagery;
• infringe upon the intellectual property, privacy, or publicity rights of any third party;
• distribute spam, malware, phishing content, or engage in any form of automated abuse;
• attempt to reverse-engineer, decompile, disassemble, or extract the source code, models, or algorithms of the Service;
• circumvent, disable, or interfere with any security, access control, rate limiting, or content moderation features;
• use the Service for any activity that violates applicable local, state, national, or international law.

9. Content Moderation and Enforcement

Pickle may employ automated content moderation on still images (including AWS Rekognition when that feature is enabled in our environment) to scan uploaded content for policy violations. Moderation can be turned off in a given deployment; when it is on, video uploads may not go through the same image-based path. We reserve the right to:

• reject, remove, or block any content that violates these Terms or our content policies;
• issue warnings or strikes against accounts that violate policies;
• temporarily suspend accounts upon accumulation of strikes;
• permanently ban accounts that engage in severe or repeated violations.

Content moderation decisions are made at our sole discretion. While we strive to be fair and consistent, we do not guarantee review of every piece of content and are not liable for any content that may bypass our moderation systems.

10. Subscriptions and Payments

Pickle offers both free and paid subscription tiers. Paid subscriptions are available through:

By subscribing to a paid plan, you agree to:

• pay the applicable fees as displayed at the time of purchase;
• automatic renewal of your subscription at the end of each billing cycle, unless cancelled before the renewal date;
• pricing changes that may occur with reasonable prior notice, taking effect at the next billing cycle;
• the payment terms, billing policies, and refund procedures of the applicable app store or payment processor.

Subscription features, usage limits, and entitlements are subject to the plan you have selected and may be modified by us with reasonable notice.

11. Free Tier and Watermarks

Pickle offers a free tier (“Explorer”) with limited features and usage. Content generated on the free tier may include a visible watermark. You agree not to:

• remove, obscure, or alter any watermarks applied to free-tier generated content;
• use automated tools, scripts, or third-party services to remove watermarks;
• claim watermarked content as premium or unwatermarked.

Upgrading to a paid subscription removes watermarks from newly generated content and may unlock additional features, higher resolution outputs, and increased usage limits.

12. Refunds and Cancellations

Refund policies depend on the platform through which the purchase was made:

• iOS (Apple App Store): Refund requests are handled by Apple in accordance with their refund policies. You may request a refund through your Apple ID account settings or by contacting Apple Support.
• Android (Google Play Store): Refund requests are handled by Google in accordance with their refund policies. You may request a refund through Google Play or by contacting Google Support.
• Web (Cashfree): Refund requests for web purchases should be directed to pickle@keyvalue.systems. Refunds will be evaluated on a case-by-case basis and processed within 14 business days if approved.

To cancel a subscription, you must do so through the platform where the purchase was made (Apple App Store, Google Play Store, or the Pickle web app) before the next billing cycle begins. Simply deleting the app does not cancel your subscription.

13. Intellectual Property

All rights, title, and interest in and to the Service, including but not limited to the following, are owned by or licensed to Keyvalue Software Systems Private Limited:

• the Pickle brand name, logo, and all associated trademarks and service marks;
• the platform’s software, source code, algorithms, architecture, and technical infrastructure;
• all templates, creative assets, styles, and curated content provided within the Service;
• the website design, user interface, user experience, and visual elements;
• all documentation, marketing materials, and written content associated with the Service.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, reverse-engineer, or otherwise exploit any part of the Service or its intellectual property without our prior written consent.

14. Third-Party Services

The Service relies on third-party providers for AI generation, cloud infrastructure, payments, analytics, and other functions. These include, but are not limited to:

Personal photos and template selections you submit for AI features may be sent only to the inference providers listed above for the purpose of generating your requested output, consistent with our Privacy Policy.

We are not responsible for the availability, accuracy, or performance of third-party services. Outages, changes, or discontinuation of third-party services may affect the availability or functionality of the Service. Your use of third-party services is subject to their respective terms and policies.

15. Disclaimers and Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties including, but not limited to:

• warranties of merchantability, fitness for a particular purpose, and non-infringement;
• any warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components;
• any warranty regarding the accuracy, quality, or likeness fidelity of AI-generated outputs;
• any warranty that generation requests will be completed within a specific time frame.

To the maximum extent permitted by applicable law, Keyvalue Software Systems Private Limited, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of business, or reputational harm, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 5,000 (Indian Rupees Five Thousand), whichever is greater.

16. Indemnification

You agree to indemnify, defend, and hold harmless Keyvalue Software Systems Private Limited, its directors, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your use of the Service or any violation of these Terms;
• your User Content, including any claim that your uploads infringe the rights of a third party;
• your use, distribution, or sharing of Generated Content;
• any breach of your representations or warranties under these Terms;
• any violation of applicable law or regulation in connection with your use of the Service.

17. Termination and Suspension

We may suspend or terminate your access to the Service, with or without notice, for any reason, including but not limited to:

• violation of these Terms or any applicable law;
• accumulation of content moderation strikes;
• fraudulent, abusive, or harmful use of the Service;
• non-payment of subscription fees;
• extended periods of inactivity, at our discretion.

You may terminate your account at any time by requesting account deletion. Upon termination:

• your right to access and use the Service will cease immediately;
• your User Content and Generated Content will be handled in accordance with our Privacy Policy (Data Retention) and Account Deletion sections (including that self-service account deletion may not immediately remove all stored media until a separate verified erasure process where applicable);
• any unused subscription benefits will not be refunded unless required by applicable law;
• provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall continue in effect.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved as follows:

• Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at pickle@keyvalue.systems. We will endeavour to resolve the matter within 30 days of receiving your written notice.
• Arbitration: If the dispute cannot be resolved informally, it shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Kochi, Kerala, India. The language of arbitration shall be English.
• Jurisdiction: Subject to the arbitration clause above, the courts of Kochi, Kerala, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms.

19. Changes to These Terms

We reserve the right to modify, update, or replace these Terms at any time. If we make material changes, we will notify you through the website, mobile application, push notification, or other reasonable means prior to the changes taking effect.

The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
